TERMS OF USE

The following terms and conditions - and future amendments - apply to all of our services directly (through the entire Mybestplanet srl network, the "Network") or indirectly (through our affiliated distributors) available online, by e-mail or by telephone. By accessing our Web site, visiting, using and/or making a reservation, you acknowledge that you have read, understood and accepted the terms and conditions set out below (including the Privacy Policy). These pages, their content and travel booking online services provided on and through one of these websites part of the Network (the "Service") are owned, managed and offered by Mybestplanet srl. and are provided for your personal use with non-commercial purposes and governed by the terms and conditions described below.

1. Scope of the service

Through our "Network" we provide an online platform that enables hotels, Bed and Breakfast, Farmhouses, Relais (including all other types of temporary accommodation henceforth referred to as "accommodation" and collectively "accommodations") to advertise their rooms for reservation and allow visitors to make online reservations through our “Network" websites. By making a reservation through the "Network", you enter into a direct contractual agreement (legally binding) with the accommodation where you make your reservation. After the reservation is made, we will solely act as intermediary between you and the accommodation, by sending to the accommodation the relevant booking details and to you a confirmation mail for and on behalf of the affiliated accommodation. When providing our services, we disclose the data that have been provided by the accommodation. The accommodations are therefore given access to an extranet, through which they are totally responsible for updating rates, room availability and other information displayed on our website. Although we will operate with diligence and accuracy, we are not able to verify and ensure the truth, extensiveness and accuracy of all information, nor are we liable for any mistakes (including obvious and typing errors), interruption of service (whether due to temporary and/or partial failure, repair, upgrade or maintenance of the booking platform or otherwise), for inaccurate, misleading or false information or non-delivery information. Each accommodation is responsible at all times of the truth, extensiveness and accuracy of (descriptive) information, including rates and availability displayed on our Network. Our network is not intended to recommend or support any particular accommodation that promotes the sale of its tourist services on our booking platform (in terms of quality, service level or classification). In addition to online booking, our platform provides for the selling of offline travel services (itineraries, guided tours, etc.) which will be called henceforth "other tourist services". For these tourist services, after a correspondence between our staff and the customer interested in the purchase of the service, advance payment will be required, or in accordance to the conditions of sale, a deposit will be paid.

2. Prices and Best Rate Guarantee

The prices on our Network are competitive and vary. All prices on Mybestplanet srl Network refer to the entire stay and are inclusive of VAT and all other taxes, unless otherwise stated on the website or e-mail confirmation. In some cases, cheaper rates for a particular stay are available on our website. However, these rates, offered by the accommodation, could have some restrictions and special conditions; for example with regards to cancellation or refund (non-refundable price). Before making a booking, please carefully check for charges conditions regarding the room you wish to book. You can also book holiday packages offered by us or by our accommodation affiliates. The cross out rate means that we have compared the rate offered with a higher rate paid (or payable) by another customer who made a reservation for that room or similar room within a calendar year of your (expected) stay. In this case you will pay a lower rate than that paid by other guests who have booked the room. This happens because the accommodation, at certain times, can decide independently to offer stays at discounted prices. Our aim is to offer, at all times, the lowest possible fare. If, after having booked through our Network, you find on the Internet the accommodation of your choice with the same booking conditions and a lower rate, we will refund the difference between our price and the lower rate you have found, according to the Best Rate Guaranteed conditions. The currency converter is for informational purposes only, and should not be relied upon as accurate and real-time operation. Please remember that conversion rates may vary.

3. Privacy

Mybestplanet and its Network use high ethical standards to protect your privacy. Unless required by law in any relevant jurisdiction, and except the disclosure of your name, email address and credit card details – for completing your booking with the accommodation of your choice - we will not disclose your personal information to third parties without your consent. However, we reserve the right to disclose your personal information to our affiliates, our employees and our affiliates’ employees, our trusted agents and representatives that, with our consent, have access to such information and who need to access it with the sole purpose of carrying out their duties on our behalf (including customer service and internal surveys companies), and for the benefit of you. 4. Free of charge and payments at checkout

Our service is free of charge. Unlike many other websites, we will not charge for the service provided and we will not charge additional costs (relating to the reservation) to the room rate. We will not charge on your credit card, as you will pay directly the accommodation during your stay. Regarding "other tourist services", payment will be agreed from time to time during the sale process, according to the booking conditions of the selected service.

5. Credit card

The accommodations require credit card details in order to guarantee your reservation. We will send the details of your credit card directly to the accommodation where you made your reservation and, at the same time, we could verify (for example, pre-authorization) the validity of your credit card. To protect and encrypt your credit card information when in transit to us, we use the "Secure Socket Layer (SSL) technology issued by our partner Verisign.com. For some rates or special offers, your credit card may be pre-authorized or charged (sometimes with a non-refundable policy) upon reservation and confirmation of booking. Before making a booking, please carefully check for charges conditions regarding the room you wish to book. To make a reservation, a valid credit card is required. In the case of fraud or unauthorized use of your credit card by a third party, most banks and companies issuing credit cards bear the risk and cover all the charges resulting from such fraud or misuse. This may sometimes be subject to a deductible [usually EUR 50 (or the equivalent in your local currency)]. In the event that the company or bank issuing your credit card will charge that amount because of unauthorized transactions resulting from a reservation made through our website, we will refund that amount up to EUR 50 (or the equivalent in your local currency). In order to receive compensation, make sure you report this fraud to the credit card provider (in accordance with its policies and procedures) and contact us immediately via e-mail (customercare@mybestplanet.com). Please state “Credit card fraud” on the mail subject, providing evidence of the excess charged (e.g. providing the policy of the credit card issuer and a copy of your credit card statement). This compensation applies only to reservations made using a secure server mode through one of Mybestplanet Network websites, and only after having verified that the unauthorized use of your credit card is a result of a failure or an act of negligence on our part and not your own misuse of the secure server.

6. Cancellation and booking changes

By making a booking with an accommodation, you accept and agree to the relevant cancellation or no-show policies of the accommodation and any other rules or additional terms of the accommodation that could be applied to your booking or during your stay, including services and/or products offered by the accommodation. The general cancellation and no-show policy for each accommodation is available on our Web site, on the accommodation information page, during the booking process and in the e-mail confirmation. Some rates or special offers are not eligible of cancellation or change (non-refundable rates). Before making a booking, please carefully check for charges conditions regarding the room you wish to book. If you wish to check, change or cancel your reservation, please refer to your e-mail confirmation and follow the instructions therein; the changes can be also made by accessing the "my booking" section. The accommodation may charge a fee in accordance with its cancellation and no show policy. Before making your reservation, we recommend that you read the cancellation and no-show policy.

7. Further correspondence

By making a booking you agree to receive an e-mail we may send you prior to your arrival date with information about your destination and reservation and special offers (including third parties offers, only if you have requested it); an email we may send you promptly after your stay inviting you to fill in a short survey regarding the accommodation you chose (Customer reviews). The questions relate to the service received and customer satisfaction: the survey is optional and is only meant to improve the service provided to users, helping them to choose among accommodations that can better meet their expectations. Apart from the booking confirmation and the customer review mails, we will not send you any further correspondence or e-mail, unless otherwise specified. You can receive further emails only upon subscribing to our newsletter, to be always updated on our promotions and offers.

8. Disclaimer

Subject to the limitation and explanations set out in the cases provided under these terms and conditions, we shall be liable only for direct damages actually suffered, incurred or paid by you, due to a failure to comply with our obligations in respect of our services. The maximum compensation can be up to the total cost of your reservation, as stated in the confirmation e-mail (whether for one event or series of connected events).

9. Miscellaneous

Unless otherwise stated, the software required to provide our services, available to or used by our "Network", the intellectual property right (including copyright) of the content, information and material on our web site are properties of Mybestplanet srl, its suppliers or its providers. The use of web pages and content of our "Network" is granted only for individual reservations of tourist services. Automated queries are not allowed. Please note that our data and other material are protected by copyright law; reproduction is therefore forbidden (especially using automated extraction of content by "scraping"). In particular, it is forbidden to transfer our data and other material to third parties (especially query results). Other companies (third parties) web sites links provided on this web site are in the sole interests of the user. By connecting to these links, you leave the Network websites. We are not responsible or reliable for the content offered by external websites. Without tangible evidence of unlawful activities, we cannot keep constantly under control the content of the linked pages. If we become aware of violations of the law, these links will be immediately removed. The user is responsible for accessing to a third-party website through a link in our web site.

10. About Mybestplanet srl

All our "Network" services are provided by Mybestplanet srl, a limited liability company governed by Italian law with registered office in Via Ingannamorte N. 10, Gravina in Puglia, Bari, Italy. Mybestplanet srl makes use of other local entities and subsidiaries that provide an internal supporting role to and for the benefit of Mybestplanet srl and its Network. These local units and subsidiaries are not authorized and do not have the legal right to provide the service, to represent Mybestplanet srl or to enter into any contract in the name of, for or on behalf of Mybestplanet srl, except for commercial representation.

11. Place of jurisdiction

These terms and conditions and the provision of our services will be governed by and interpreted in accordance with Italian law. Any dispute arising under these terms, general conditions and our services will be referred exclusively to the court jurisdiction of the Province of Bari (Puglia - Italy). The original bilingual text, in Italian and in English, of these Terms and Conditions is translated into other languages. The version translated into other languages is unofficial and for illustrative purposes only, and bears no legal value. In case of dispute or inconsistency or discrepancy between the bilingual Italian/English version and other languages version of these Terms and Conditions, the bilingual Italian/English version shall apply, prevail and be conclusive. The bilingual Italian/English is available on the websites of our "Network" (by selecting the Italian or English language) or shall be sent to you upon your written request.
